SCC TOOLKIT is owned by Southern Cross Computing Pty Ltd and is protected by Australian copyright laws and international treaty provisions, and all other applicable national laws. Therefore, you must treat SCC TOOLKIT like any other copyright material (eg. a book or musical recording) except that you may copy solely for backup or archival purposes.

Other Restrictions

You may not rent or lease SCC TOOLKIT but you may transfer SCC TOOLKIT and accompanying materials provided you retain no copies and the recipient agrees to the terms of this Agreement. You may not reverse engineer, decompile, or disassemble SCC TOOLKIT. Any transfer must include the most recent update and all prior versions.

Limited Warranty

Southern Cross Computing Pty Ltd warrants that SCC TOOLKIT will perform substantially in accordance with the accompanying documentation for a period of ninety (90) days from the date of receipt. This warranty expressly excludes problems caused either directly or indirectly by modifications to any aspect of the environment within which SCC TOOLKIT operates. Any implied warranties on SCC TOOLKIT are limited to ninety (90) days.

Customer Remedies

Southern Cross Computing Pty Ltd's entire liability and your exclusive remedy shall be, at Southern Cross Computing Pty Ltd's option, either (a) return of the price paid or (b) repair or replacement of the copy of SCC TOOLKIT that does not meet Southern Cross Computing Pty Ltd's Limited Warranty and which is returned to Southern Cross Computing Pty Ltd with a copy of your receipt. This Limited Warranty is void if failure of SCC TOOLKIT has resulted from accident, abuse, or misapplication. Any replacement of SCC TOOLKIT will be warranted for the remainder of the original warranty or thirty (30) days, whichever is the longer.

Disclaimer

Southern Cross Computing Pty Ltd disclaims all other warranties, either express or implied, including but not limited to the profitability of or any other consequences or benefits to be obtained from the delivery or use of SCC TOOLKIT and any accompanying materials.

Except as to the extent that it is hereinbefore provided, under no circumstances shall Southern Cross Computing Pty Ltd or any related company be liable for any loss, damage or injury (including without limitation any loss of profit, indirect, consequential or incidental loss, damage or injury) arising from the supply or use of SCC TOOLKIT and any accompanying written materials or any failure by Southern Cross Computing Pty Ltd or any related company to perform any obligation or observe any terms of this Agreement.
